This degree work will address the extracontractual liability of the State and especially, the situation of Ecuador, regarding reparation to victims in cases of objective extracontractual liability of the State. It begins with a historical review of the responsibility of the State, and how this evolution occurred in Ecuador; then the current situation of Ecuador will be analyzed, in terms of its regulations and the treatment that Ecuadorian jurisprudence has given to the objective extracontractual responsibility of the State. In its second part, the Colombian experience and its contributions are studied to determine the forms of compensation when the State has been found responsible. And finally, it will be determined if it does or does not lack a regulation that determines parameters for the compensation and what type of norm could be the one that regulates these parameters.
Este trabajo de titulación abordará la responsabilidad extracontractual del estado y especialmente, la situación de Ecuador, respecto a la reparación a víctimas en casos de responsabilidad extracontractual objetiva del Estado. Se inicia con una revisión histórica de la responsabilidad del Estado, y cómo esta evolución se dio en el Ecuador; luego se analizará la situación actual del Ecuador, en cuanto a su normativa y el trato que le ha dado la jurisprudencia ecuatoriana a la responsabilidad extracontractual objetiva del Estado. En su segunda parte se estudia la experiencia colombiana y sus aportes para determinar las formas de indemnización cuando el Estado se ha encontrado responsable. Y finalmente, se determinará si hace o no falta una normativa que determine parámetros para la indemnización y que tipo de norma podría ser la que regule dichos parámetros.
