El estándar de responsabilidad del fiduciario mercantil

Description: The present dissertation addresses the issue of contractual liability. Like any bilateral contract the Ecuadorian commercial law states that the trustee is liable for ordinary fault. However, the introduction of the civil rule contained in paragraph 2 of Article 2033 Civil Code, permits look more narrowly the paid mandatary liability. That is, the interpretation to be used to punish acts of the trustee shall be more severe and therefore respond more strictly than the simple measure of ordinary fault.
La presente tesina aborda el tema de la responsabilidad contractual de un fiduciario mercantil. Como todo contrato bilateral, la Ley de Mercado de Valores manifiesta que el fiduciario responde por culpa leve. Sin embargo, el introducir la norma civil contenida en el artículo 2033 inciso 2 del Código Civil, permite mirar con mayor estrictez la responsabilidad de un mandatario remunerado. Es decir, que la interpretación a emplear para sancionar los actos del fiduciario mercantil deberá realizarse con mayor severidad y en consecuencia, responde más estrictamente que al simple grado de responsabilidad por culpa leve.
